Terms of Service

These Terms of Service govern your access to and use of the Alejo Automations website (alejoautomations.com) and the custom software development, automation, and consulting services we provide. By using our website or engaging us for services, you agree to these terms.

1. Services

Alejo Automations provides custom software development, AI automation, chatbot, quote generation, operations platform, and related consulting services. The specific scope of any engagement is defined in a written proposal or statement of work agreed between us and the client.

2. Engagement structure

Most engagements include a one-time setup or build fee plus an ongoing monthly retainer that covers hosting, maintenance, support, and continuous improvements. Pricing, deliverables, and timelines are specified in each project's written proposal.

3. Payment

Payments are processed via Stripe and are due according to the schedule defined in the relevant proposal — typically a setup fee at project start and a recurring monthly retainer thereafter. Invoices are payable in U.S. dollars unless otherwise stated.

Late payments may result in suspension of services until the account is brought current.

4. Cancellation and refunds

Monthly retainers are cancellable with 30 days' written notice. The setup or build fee covers the design, development, and deployment work and is non-refundable once project work has begun, except where required by law or where we have failed to deliver agreed work. Specific refund terms for any given engagement are stated in the project proposal.

5. Intellectual property

Upon full payment of all fees, the client receives a license to use the custom software we deliver for their internal business operations. Alejo Automations retains the right to reuse generic, non-confidential components, frameworks, and methodologies developed during the engagement.

6. Confidentiality

We treat client business information, data, and credentials as confidential and use them only to provide the services. We will not disclose confidential information to third parties except as required to deliver the services or by law.

7. Warranties and disclaimers

We deliver services with reasonable care and skill. To the maximum extent permitted by law, our services are provided “as is” and we disclaim all other warranties, express or implied, including merchantability and fitness for a particular purpose.

8. Limitation of liability

To the maximum extent permitted by law, Alejo Automations' total liability under any engagement is limited to the fees paid by the client in the twelve (12) months preceding the event giving rise to the liability. We are not liable for indirect, incidental, or consequential damages.

9. Third-party services

Our deliverables may rely on third-party services such as Supabase, Stripe, Vercel, Railway, Anthropic, OpenAI, Meta WhatsApp Cloud API, Resend, and others. Third-party service availability, pricing, and terms are outside our control.

10. Acceptable use

You agree not to use our website or services for any unlawful purpose, including but not limited to fraud, harassment, infringement of intellectual property, or distribution of malicious software.

11. Governing law

These terms are governed by the laws of the jurisdiction in which Alejo Automations operates. Any dispute will be resolved through good-faith negotiation first; if unresolved, by the courts of that jurisdiction.

12. Changes

We may update these Terms of Service from time to time. The “Last updated” date reflects the most recent revision. Continued use of our services after a change constitutes acceptance of the updated terms.
